Terms of service
The terms for using Nexumera: what we offer, how billing works and what we expect from you and your team.
Who we are
Nexumera is a service of Juan Pablo Egido Castellanos (sole proprietor, persona natural), located at WeWork, Calle 7D, Medellín, Antioquia, Colombia (“Nexumera”, “we” or “us”). You can reach us at hola@nexumera.com.
These terms govern the use of Nexumera by the company that subscribes to a plan (“the customer”) and by the people the customer authorizes to use it. By subscribing to a plan or using the service, the customer accepts them.
The service
Nexumera is an AI workspace connected to your company data. It lets you ask questions in your own words, approve each query before it runs, choose the AI model and build dashboards and routines. What each plan includes is described on the pricing page.
Nexumera is a service for businesses. Whoever subscribes declares that they act on behalf of a company and have the authority to accept these terms.
Accounts and users
The customer is responsible for its users’ accounts, for keeping their credentials secure and for the activity in its workspace. Let us know right away if you detect unauthorized access.
Each plan has a maximum number of members and data sources. If you need more, you can change plans at any time.
Orders and payments
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the merchant of record for all our orders: it processes payments, calculates and collects taxes, issues invoices and handles payment and refund inquiries.
- Prices are published in US dollars (USD) on the pricing page.
- Applicable taxes are calculated for your country and added at checkout.
- Paddle issues the invoice for each charge and sends it to the customer’s billing email.
- Subscriptions renew automatically at the end of each monthly or annual period until the customer cancels them.
- If we change a plan’s price, we will tell you at least 30 days before your next renewal. The new price applies from that renewal.
Cancellation and refunds
You can cancel your subscription at any time. Cancellation takes effect at the end of the period already paid: you keep access until then and no further charges are made.
Refunds are governed by our Refund policy, which includes a refund of your first payment if you ask within 14 days of purchase.
Your data
The data you connect to Nexumera belongs to the customer. We use it only to provide the service. Processing of personal data is described in the Privacy policy.
AI answers may contain errors. The customer is responsible for reviewing them before making decisions with them and for holding the necessary rights over the data it connects.
Acceptable use
The customer and its users agree not to:
- Use the service for illegal activities or to process data without authorization.
- Infringe third-party rights, including intellectual property and privacy rights.
- Try to access other customers’ data, bypass plan limits or compromise the security of the service.
- Resell or sublicense the service without our written permission.
Intellectual property
Nexumera, its software and its brand belong to Juan Pablo Egido Castellanos. The subscription gives the customer a limited, non-exclusive, non-transferable right to use the service while it is active. The customer keeps all rights over its data and over the results it obtains from it.
Availability and warranties
We work to keep the service available and working well, but there may be interruptions for maintenance or for reasons beyond our control. To the extent permitted by law, the service is provided “as is”, without warranties beyond those described in these terms.
Liability
To the extent permitted by law, our total liability to the customer is limited to the amount the customer paid for the service in the 12 months before the event giving rise to it. We are not liable for indirect damages or lost profits. Nothing in these terms limits a liability that the law does not allow to be limited.
Suspension and termination
We may suspend or terminate access if the customer seriously breaches these terms or does not pay, with prior notice when possible. After termination, the customer can ask us for a copy of its data within the following 30 days; after that we delete it.
Changes to these terms
We may update these terms. If a change is significant, we will email you at least 30 days before it takes effect. The date of the last update appears at the top of this page.
Governing law
These terms are governed by the laws of the Republic of Colombia, without prejudice to any non-waivable rights granted to you by the law of your country.
